Tented Getaways is a niche travel platform focused on showcasing, marketing, facilitating inquiries for, and in certain cases enabling bookings for tented camps, safari lodges, glamping destinations, and related outdoor accommodation experiences.

Depending on platform development stage, Tented Getaways may operate as:

• An accommodation discovery platform
• An inquiry facilitation platform
• A booking intermediary
• A referral, affiliate, or white-label platform
• A direct booking technology provider

Unless expressly stated otherwise, Tented Getaways does not own, operate, control, or directly manage listed properties.

2. Supplier Independence

All accommodation providers, property owners, operators, and suppliers listed on Tented Getaways are independent third parties. Each supplier is solely responsible for:

• Listing accuracy
• Property descriptions
• Rates and pricing
• Availability
• Booking fulfillment
• Guest safety
• Legal compliance
• Insurance
• Cancellations
• Refunds
• Service standards
• Regulatory approvals

Tented Getaways does not assume operational control over supplier businesses solely because they are listed on our platform.

3. User Responsibilities

By using Tented Getaways, you agree that you are responsible for:

• Reviewing supplier information carefully
• Confirming rates, availability, and policies
• Understanding cancellation and refund terms
• Assessing whether a property meets your needs
• Making informed travel decisions
• Providing accurate personal information

You acknowledge that travel and accommodation decisions involve personal judgment and may carry inherent risks.

4. Bookings, Inquiries & Third-Party Transactions

Tented Getaways may provide inquiry forms, referral links, affiliate pathways, white-label booking tools, or direct booking integrations depending on service structure. Where a booking, reservation, payment, or agreement involves a third-party supplier:

• The supplier's terms may also apply
• The supplier remains primarily responsible for delivery of booked services
• Payment processing may involve third-party systems
• Tented Getaways may act only as a facilitator or intermediary unless expressly stated otherwise

5. No Guarantee

While we strive to maintain high-quality listings and platform standards, Tented Getaways does not guarantee:

• Supplier conduct
• Property quality
• Listing completeness
• Availability
• Pricing accuracy
• Safety outcomes
• Legal compliance by suppliers
• Uninterrupted platform availability

6. Limitation of Liability

To the fullest extent permitted by applicable law, Tented Getaways, its directors, owners, affiliates, staff, contractors, or partners shall not be liable for:

• Accommodation disputes
• Supplier misconduct
• Property defects
• Cancellations
• Refund disputes
• Injuries or accidents
• Misrepresentation by suppliers
• Travel interruptions
• Force majeure events
• Payment processor failures
• Third-party acts or omissions

7. Supplier-Related Disputes

Any disputes concerning accommodation, supplier performance, refunds, cancellations, injuries, or supplier obligations should primarily be addressed directly with the relevant supplier or responsible third party.

Tented Getaways may, at its discretion, assist in communication but is not obligated to assume liability for supplier disputes unless required by law.

8. User Conduct

You agree not to:

• Use the platform unlawfully
• Submit false or misleading information
• Abuse suppliers, property owners, or staff
• Attempt unauthorized access
• Interfere with platform functionality
• Copy, exploit, or misuse platform content without permission

9. Intellectual Property

All Tented Getaways branding, website design, text, logos, systems, content structures, and proprietary materials are owned by or licensed to Tented Getaways unless otherwise stated.

Unauthorized use, reproduction, or distribution is prohibited.

10. Supplier Content & Marketing Rights

By submitting listings, photographs, videos, descriptions, or related promotional material to Tented Getaways, suppliers grant Tented Getaways a non-exclusive, royalty-free right to use, display, reproduce, distribute, and market such content across:

• Website listings
• Social media
• Advertising campaigns
• Email marketing
• Promotional partnerships

This right is granted for the purpose of platform growth, marketing, and booking promotion unless otherwise agreed in writing.

11. Reviews & User Content

Users may submit reviews, ratings, comments, or other content where permitted. By submitting content, you confirm:

• It is truthful to the best of your knowledge
• It does not violate law or third-party rights
• Tented Getaways may display, moderate, or remove it at its discretion

12. Suspension, Removal & Refusal of Service

Tented Getaways reserves the right to reject, remove, or suspend listings, suppliers, or users where necessary to protect platform quality, safety, legal compliance, or brand integrity.

13. Privacy

Your use of Tented Getaways is also subject to our Privacy Notice. Our Cookie Policy separately explains how cookies and related technologies are used on our platform.

14. Force Majeure

Tented Getaways shall not be held responsible for delays, disruptions, or failures caused by events beyond reasonable control, including natural disasters, pandemics, supplier insolvency, governmental restrictions, or technology failures.

15. Governing Law

These Terms shall be governed by and interpreted under the laws of South Africa unless otherwise required by applicable jurisdiction.

16. Changes to These Terms

We may update or revise these Terms periodically to reflect platform evolution, legal obligations, or service changes.

Continued use of Tented Getaways after updates constitutes acceptance of revised Terms.
